Probate Administration
You can pursue the faster, less expensive Summary Administrative process if the estate is valued at $75,000 or less (excluding exempt property) and there are no debts. Summary administration does not calculate the decedent's home when determining the value of the estate as a person's homestead is exempt property under Florida law.
For estates valued at more than $75,000 a Formal Administrative process must be followed. This process includes:
- Appointing a personal representative
- Documenting the estate's inventory
- Notifying creditors
- Paying claims
- Distributing assets
It is important to consult with a qualified lawyer to determine exempt property and ensure asset distribution is handled correctly. If assets are distributed prematurely, you and other heirs could suffer serious financial consequences. The law places responsibility with beneficiaries to pay creditors. If debts are not addressed and handled properly, you could face a lawsuit.
